Terms of Use for Document Butler

1. Scope of application

These Terms of Use govern the use of the "Document AI Butler" app offered by Document AI Butler (hereinafter "we", "us"). By installing and using the app, you expressly agree to these Terms of Use.

2. Purpose of the app

The purpose of the app is to make it easier for users to understand documents by reading and interpreting them using OCR technology. The interpretations are provided in the language chosen by the user. The app does not provide legal advice and does not guarantee the accuracy of the interpretations. We therefore expressly exclude liability for any incorrect interpretation. Users are strongly advised to contact the sender of the documents and have the letter explained to them personally in order to avoid misunderstandings and to avoid drawing false conclusions that could be detrimental to the user.

3. Age restriction

Use of the app is reserved for persons over the age of 18.

4. Fees and payments

There is a charge for downloading the app from the App Store. There are no additional in-app purchases.

5. Data protection

If you download our mobile app via an app store, the required information is transmitted to the app store, in particular your user name, email address and customer number of your account, time of download, payment information and the individual device code. We have no influence on this data collection and are not responsible for it. We only process the data to the extent necessary to download the mobile app to your mobile device.

When you use our mobile app, we collect the personal data described below to enable convenient use of the functions and to ensure stability and security:

- Date and time of the request

- Time zone difference to Greenwich Mean Time (GMT)

- Content of the request

- Access status/http status code

- Amount of data sent in bytes

- Source/reference from which you reached the page

- Browser used

- Language and version of the browser software

- Operating system used and its interface

- IP address used (if applicable: in anonymized form)

- Unique number of the end device (IMEI)

- Unique number of the network subscriber (IMSI)

- Mobile phone number (MSISDN), possibly MAC address for WLAN use

- Name of your mobile device

Processing is carried out in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our legitimate interest in improving the stability and functionality of our app. We collect and process our users' personal data exclusively in accordance with the statutory provisions and our privacy policy. We are committed to protecting the privacy of our users and treating their data confidentially. Your personal data will not be passed on to third parties without your express consent, unless there is a suspicion of illegal and criminal behavior or we are legally obliged to pass it on.

6. Rights of use and restrictions

Users may upload and have interpreted up to 100 documents within one year from the date of downloading the app. This year begins on the day the app is downloaded and ends on the day before the same date in the following year.

The uploaded documents must relate to the user personally. Uploading third-party documents is prohibited. We are not obliged to check whether the user is authorized to upload the documents. Should the rights of third parties be infringed by the uploading of documents, the user alone is expressly liable for any resulting damage or infringements.

Users are obliged to make all details in the documents that could lead to the identification of a person, such as names, addresses, telephone numbers, dates of birth and other sensitive information that should typically not be shared publicly on the Internet, unrecognizable before uploading. This measure serves to protect your privacy and helps to ensure the security of personal data. We accept no liability for the consequences of failure to comply with this requirement. In addition, we cannot rule out the possibility that personal data that has not been made unrecognizable may be used for training our language model in order to improve the performance of the app.

By uploading a document for interpretation by "Document AI Butler", the user agrees that the uploaded documents will be used for the purpose of interpretation by the app. The user also grants us the right to use the results of the interpretation anonymously for training and improving the language model of our app. This helps us to increase the accuracy, efficiency and performance of the app. It is expressly pointed out that all personal details that could lead to the identification of the user must be made unrecognizable before uploading in order to ensure the privacy and security of the user data. We undertake to use the anonymized interpretation results exclusively to improve the app and not for any other purpose.

The documents will not be reproduced, passed on or used in any other way. The user grants us the necessary rights to the document to enable its interpretation. This excludes the possibility of users subsequently requesting the deletion of the document or its data from the language model, as we have no insight into the individual interpretations. The transfer of rights only serves to enable the technical implementation of the interpretation and to exclude legal claims in relation to the uploaded material.

7. Code of conduct

Illegal content or third-party documents may not be uploaded. The use of the app for commercial purposes or to obtain financial benefits is prohibited.

8. Consequences of violations

In the event of violations of these terms of use, we may restrict or completely block the use of the app. The decision lies exclusively with us. In addition, we reserve the right to assert claims for damages if the user causes damage by violating the terms of use.

9. Cancellation and termination

Users can delete the app at any time. We can also deactivate the app at any time and restrict or block its use.

10. Changes to the terms of use

We reserve the right to change these Terms of Use at any time. Users will be informed of such changes.

11. Copyright information

All content, designs, text, graphics, logos and images as well as the name "Document AI Butler" are protected by copyright and are the property of "Document AI Butler" or are used with appropriate permission. These elements are protected by copyright, trademark law and other intellectual property rights. The use, reproduction, distribution, display, modification, transmission or exploitation of such copyrighted works, whether for commercial or non-commercial purposes, is strictly prohibited without the prior written consent of App-Butler.

In the event of infringement, we reserve the right to take legal action to protect our rights. This may include taking legal action to stop unauthorized use and claiming damages from those who infringe our copyrights or other intellectual property rights.

12. Availability and stability of the app

We endeavor to keep "Document AI Butler" accessible and functional at all times. However, users acknowledge that the full availability and error-free functioning of the app cannot be guaranteed due to technical reasons, maintenance work, updates or circumstances beyond our control. We reserve the right to temporarily restrict or interrupt the operation of the app for such reasons without this giving rise to any claims by users against us.

We undertake to take reasonable measures to ensure the security, stability and functionality of the App, including regular updates and maintenance work. Should technical problems or malfunctions occur, we will endeavor to rectify them as quickly as possible.

Users are informed that their user experience may vary due to the nature of the internet and electronic communications. No liability is accepted for any damage that may be caused by such technical fluctuations, including interruptions in availability or delays in processing.

Severability clause

Should one or more provisions of these Terms of Use be or become void, invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions of the Terms of Use. The void, ineffective or unenforceable provision shall be replaced by a provision that comes closest to what the parties actually and economically intended according to the original meaning and purpose of the void, ineffective or unenforceable provision. The same applies to loopholes in these Terms of Use.
